SpotHK Collectables: Terms of Service

Welcome to SpotHK Collectables. By accessing our website and purchasing our products, you agree to be bound by the following Terms of Service. If you do not agree with any part of these terms, you must not use our website.

1. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (excluding credit card information) may be transferred unencrypted and involve transmissions over various networks.

2. Accuracy, Completeness, and Timeliness of Information

  • Product Descriptions: We strive to be as accurate as possible with our product descriptions and high-resolution imagery. However, we do not warrant that product descriptions or other content are error-free.

  • Collectibles & Grading:

    • Trading Cards: Any condition assessments (e.g., "Near Mint," "Lightly Played") provided by SpotHK Collectables are our subjective professional opinions and strictly for guidance. They are not guaranteed grades from third-party services (like PSA, BGS, or CGC) unless the item is sold in an encapsulated, graded slab. We are not liable if a raw card receives a different grade than expected if you choose to submit it for grading.

    • Models: Vintage and pre-owned models are sold as collectibles. Unless explicitly stated, we do not guarantee the functionality of electronic components (lights/sounds) in vintage items due to their age.

3. Modifications to the Service and Prices

  • Market Volatility: Prices for our products are subject to change without notice. The collectibles market is volatile; we are not responsible for market value drops that occur after your purchase.

  • Pricing Errors: We reserve the right to cancel any order placed for a product listed at an incorrect price due to typographical error or error in pricing information. If your credit card has already been charged, we will issue a full refund.

4. Risk of Loss

All items purchased from SpotHK Collectables are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

5. Prohibited Uses

In addition to other prohibitions, you are prohibited from using the site:

  • (a) To use any automated systems (bots, scrapers) to purchase inventory faster than humanly possible (anti-scalping clause);

  • (b) To infringe upon or violate our intellectual property rights;

  • (c) To submit false or misleading information.

6. Limitation of Liability

In no case shall SpotHK Collectables, our directors, officers, employees, affiliates, or agents be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise.

Our maximum liability to you for any claim related to a purchase shall not exceed the amount paid by you for that specific item.

7. Indemnification

You agree to indemnify, defend, and hold harmless SpotHK Collectables from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service.

8. Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Hong Kong SAR.
